Terms of Service

Welcome to Outpulse. These Terms of Service ("Terms") govern your access to and use of the Outpulse platform, website, APIs, and related services (collectively, the "Service") operated by Outpulse ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Service.
1. Eligibility & Account Registration
- You must be at least 16 years of age to use Outpulse.
- By registering, you represent that all information you provide is accurate, current, and complete.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You may not share your account with any third party or use another user's account without permission.
- We reserve the right to suspend or terminate accounts that violate these Terms.
2. Description of Service
Outpulse is an AI-powered social media outreach automation platform that connects to your X (Twitter) account via OAuth to:
- Monitor X (Twitter) for posts matching your configured Ideal Customer Profile (ICP).
- Score posts for buyer intent using AI models (Claude, Grok).
- Draft personalized replies and direct messages for your review or automatic posting.
- Schedule and post approved content to X on your behalf, subject to your account's posting limits.
- Deliver email digests summarizing activity and signals.
The Service operates on a subscription-based pricing model. Each plan includes a monthly outreach quota (Reply+DM or DM-only sends) that resets at the start of every billing cycle. Scanning, AI intent scoring, and draft generation are included in all plans at no additional cost — you only spend from your quota when an outreach is successfully sent.
3. X (Twitter) Account Connection & Your Obligations
3.1 OAuth Authorization
By connecting your X account, you grant Outpulse OAuth permissions to read your profile and tweet on your behalf. You may revoke this authorization at any time from your X account settings. Revoking access will disable posting features but will not delete your Outpulse account or data.
3.2 Compliance with X Platform Rules
We've designed Outpulse to work within X's Terms of Service, Developer Agreement, and Automation Rules. As a user, we ask that you also use the platform in a way that aligns with these guidelines. This means:
- Using Outpulse for genuine, good-faith outreach — not bulk unsolicited messaging or content that could be considered unwelcome.
- Staying within X's recommended limits on automated actions (follows, likes, retweets, DMs, replies).
- Avoiding any use that could be seen as artificial engagement, manipulation of trending topics, or coordinated inauthentic behavior.
- Ensuring your outreach is respectful, inclusive, and not directed in a discriminatory way.
Outpulse implements rate limiting, daily action caps, and human-behavior delays as built-in safety measures. While these are designed to keep your usage well within safe boundaries, we encourage you to use the platform thoughtfully. In the event of any X policy enforcement on your account, we'll do our best to help, though we're unable to intervene directly with X's decisions.
3.3 Content Responsibility
All content posted to X through Outpulse — whether AI-drafted and auto-posted, or manually approved — is your content. We encourage you to review AI-generated drafts for accuracy, tone, and appropriateness before enabling automatic posting, especially when first getting started. Our goal is to help you send outreach you're proud of.
4. Acceptable Use
You agree NOT to use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Generate or distribute spam, phishing content, malware, or deceptive content.
- Scrape, crawl, or extract data from the Service beyond normal use.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Circumvent rate limits, technical access controls, or billing mechanisms.
- Resell, sublicense, or provide access to the Service to third parties without our prior written consent.
- Use the Service to engage in any activity that damages Outpulse's reputation, infrastructure, or relationships with third-party API providers.
5. Billing, Subscriptions & Refunds
5.1 Subscriptions
Plans are billed monthly through our billing partner (Dodo Payments) and activate immediately upon successful payment. Each plan includes a set outreach quota that refreshes at the start of each billing cycle. All purchases are final unless expressly stated otherwise.
5.2 What's Included
All plans include unlimited signal scanning, AI intent scoring, and personalized draft generation at no extra charge. Your monthly outreach quota is consumed only when an outreach action (Reply+DM or DM-only) is successfully sent. Unused quota does not carry over to the next billing cycle.
We reserve the right to adjust plan inclusions with reasonable prior notice. Changes will apply prospectively from the next billing cycle.
5.3 Refunds
If you experience a technical error that results in an outreach being counted without a corresponding action being completed, please contact us at [email protected] within 30 days and we will investigate and issue a correction if warranted.
5.4 Account Termination
If your account is terminated for violation of these Terms, your subscription will be cancelled immediately with no refund of the remaining period. If you choose to close your account voluntarily, you may cancel from the Settings page and your access continues until the end of the current billing period.
6. AI-Generated Content
Outpulse uses large language models (including Anthropic Claude and xAI Grok) to generate draft replies and messages. You acknowledge that:
- AI-generated content may be inaccurate, incomplete, biased, or inappropriate.
- You are responsible for reviewing all AI-generated drafts before they are published.
- Enabling automatic posting means you accept responsibility for all content posted without manual review.
- We make no warranty regarding the quality, accuracy, or effectiveness of AI-generated content.
7. Intellectual Property
7.1 Our IP
The Service, including its software, algorithms, design, logos, and documentation, is owned by Outpulse and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any part of the Service.
7.2 Your Content
You retain ownership of any content you input into the Service (ICP configuration, monitor keywords, manually written messages). You grant Outpulse a limited license to use this content solely to provide the Service to you.
7.3 Feedback
If you submit feedback, bug reports, or feature suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.
8. Third-Party Services
The Service integrates with third-party services including:
- X (Twitter) — for OAuth and content posting
- Anthropic Claude / xAI Grok — for AI draft generation
- Neon / PostgreSQL — for data storage
- Upstash — for queue management and rate limiting
- Resend — for transactional email
- Dodo Payments — for billing and payments
- Vercel — for hosting and infrastructure
Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.
9. Disclaimers & Limitation of Liability
9.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUTPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR X ACCOUNT SUSPENSION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO OUTPULSE IN THE 90 DAYS PRECEDING THE CLAIM.
9.3 X Account Risks
Automating actions on X carries a degree of inherent risk, and X's enforcement policies can change. We work hard to keep Outpulse's behavior well within safe and compliant boundaries, but we're unable to guarantee outcomes from X's side. In the unlikely event your account is affected by an X enforcement action, we're here to help you understand what happened and how to move forward.
10. Indemnification
You agree to indemnify, defend, and hold harmless Outpulse, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including X's Terms of Service; or (d) content you post through the Service.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe: (a) violates these Terms; (b) violates X's policies in a manner harmful to other users or our platform; or (c) poses legal or reputational risk to Outpulse.
You may terminate your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, and 13 survive termination.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (to the address on your account) or by a prominent in-app notice at least 14 days before the changes take effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration, except where prohibited by law.
